Colorado Naturopathic Practice Bill Defeated in Committee

Thursday April 23, 2009

Colorado House Bill 09-1175, known as the Naturopathic Practice Act, was defeated yesterday morning at 10:16 AM in the Health and Human Services Committee by a vote of 5 to 2. Had it passed, it would have eliminated traditional naturopathic practitioners in Colorado, including herbalists, nutritionists, and wellness consultants of all kinds, and granted the right to practice any form of traditional healing to a handful of graduates from specified schools of naturopathy.

The following votes were cast on the issue:

Morse - Yes
Newell - Yes
Lundburg - NO
Carroll - absent
Schulthies - NO

Thanks so very much for all of you who sent petitions to these committee members urging them to defeat the bill.

This doesn't halt the problem; it just delays it until the next Colorado congressional session. It does, however, give us some time to rally the forces to get a good Health Freedom Safe Harbor Exemption Law passed similar to the one New Mexico passed on March 21, 2009.

THE NATUROPATHIC PRACTICE ACT
(Information and Petitions Provided by Colorado For Health Freedom)
Read the text of the bill

Colorado House Bill 09-1175, known as the Naturopathic Practice Act,
would eliminate traditional naturopathic practitioners in Colorado.

The definition of "traditional naturopathic practitioners" would include by definition all but a select few natural health care providers, herbalists, and distributors of natural health products, as well as anyone who currently provides any form of natural health or nutritional counseling or advise, and could also be interpreted to include proprietors of health food stores. It would then provide a monopoly on the practice of all forms of natural health care to the graduates of only a select few schools. HB1175 endangers consumer choices and health freedoms, and endangers natural health care practitioners' right to practice their trades by creating an exclusive monopoly on who provides natural, complementary, and alternative therapies, information, and services.

HB1175 would make it a crime for thousands of unlicensed persons to practice their trades and would destroy THOUSANDS of Colorado entrepreneurial natural health based businesses, unless the practitioners are registered naturopathic doctors mandated to graduate from a particular group of schools. Colorado would lose millions in personal income and State Revenue loss in sales tax and Income tax.

As Americans who are concerned about our dwindling health freedoms, we should all actively oppose any and all mandates that require all people to obtain permission from the state to do a healing act.  Minnesota, California, Rhode Island, Louisiana, Oklahoma, and Idaho all have health freedom laws that exempt unlicensed practitioners from criminal statutes as long as they avoid specific prohibited conduct and give out proper disclosures. On 3-21-09 New Mexico passed the Unlicensed Health Care Practice Act HB664. These laws just make good, common sense, and protect both the health care giver and the health care seeker.

If you value your freedom to manage your own health care using practitioners of your own choosing, you need to take an active stance against any law that would restrict the health freedom of any American living in any state! If you are not particularly concerned about the protection of health care choices, you should still be concerned about any legislation that would force thousands of entrepreneurs out of business and provide monopolies to any "elite" groups of individuals. That's not what our failing economy really needs right now!

This monopolistic naturopathic doctor bill has been assigned to the Senate Health and Human Services Committee, and could be heard as early as next Wednesday, April 1st. When we (Colorado For Health Freedom) have a definite date and time, we will send an email out to the Yahoo! Colorado For Health Freedom Group and post it on the Colorado For Health Freedom website.

Please call, fax, and/or email the members of this committee and ask them to OPPOSE HB 1175. It is always best if you can write a personal letter, but if you are unable to do so, we have provided three different versions a one page paper that you can use to fax to the committee members.

Why is this bill dangerous to America's health freedoms?

In addition to the reasons cited above, this bill could possibly be used to even control the way parents care for their children. Some of the definitions of this Act are as follows:

“‘Naturopathic Medicine’ means a system of health care for prevention, naturopathic diagnosis, and naturopathic treatment of human health conditions, injury, and disease; the promotion or restoration of health; and the support and stimulation of a patient’s inherent self-healing processes through patient education and the use of naturopathic physical modalities and remedies.

“‘Naturopathic Modalities’ means lifestyle counseling and the physical forces of heat, cold, water, touch, and light. ...

“‘Naturopathic Remedies’ means the use of food, extracts of food, nutraceuticals, vitamins, amino acids, minerals, enzymes, botanicals and their extracts, homeopathy, and all dietary supplements.”

By these definitions, any parent who provides for “the promotion or restoration of health” of his or her own child through the “the use of food, extracts of food, nutraceuticals, vitamins, amino acids, minerals, enzymes, botanicals and their extracts, homeopathy, and all dietary supplements” could potentially be charged with the crime of practicing Naturopathic Medicine without a license.
